The Customer Data Processing Principles are a document that governs the basic grounds and conditions for processing Customer Data in the Customer’s relations with OÜ Amper ja volt Solarworks. OÜ Amper ja volt Solarworks considers the protection of Customer Data very important in its operations and always ensures a high level of Customer Data protection and the lawfulness and purposefulness of Customer Data processing.
1. Definitions
OÜ Amper ja volt Solarworks is a legal entity with registry code 12220400, located at Tehase tn 5, 76605 Keila, Harju County, which processes personal data in accordance with the requirements of the legislation in force in Estonia.
Customer Data is any data about the Customer.
Processing of Customer Data is any operation performed with Customer Data, including collection, recording, organising, storing, altering and disclosing, granting access, making queries and extracts, use, transmission, cross-use, combining, closing, erasure or destruction, or several of the aforementioned operations, regardless of the manner in which the operations are performed and the means used.
A Customer is any natural or legal person who uses or has expressed a wish to use the products or services of OÜ Amper ja volt Solarworks and whose data OÜ Amper ja volt Solarworks processes in accordance with the Data Protection Act.
A Third Party is a natural or legal person who is not the Customer, OÜ Amper ja volt Solarworks, or a natural person who processes Customer Data under the authority of OÜ Amper ja volt Solarworks.
2. Start of Customer Data processing
By entering into a transaction with OÜ Amper ja volt Solarworks, or by expressing a wish to enter into one, the Customer accepts the processing of Customer Data by OÜ Amper ja volt Solarworks in accordance with these Customer Data Processing Principles of OÜ Amper ja volt Solarworks.
3. Purposes of Customer Data processing
OÜ Amper ja volt Solarworks processes Customer Data in order to:
• fulfil obligations undertaken towards the Customer in providing its products or services;
• offer the Customer the products and services of OÜ Amper ja volt Solarworks;
• better understand the Customer’s expectations regarding the products and services of OÜ Amper ja volt Solarworks (e.g. customer surveys, market research, etc.);
• organise consumer games and campaigns;
• pass information about the Customer to AS Creditinfo Eesti or another payment default register operator if the Customer has an unfulfilled financial obligation, in order to give the register’s users information about the Customer’s previous payment behaviour;
• pass information about the Customer to a person providing services to OÜ Amper ja volt Solarworks (e.g. auditor, IT, archive or legal service provider, etc.);
• pass data needed for providing services to OÜ Amper ja volt Solarworks to subcontractors (authorised processors). Such services form part of the complete service offered by OÜ Amper ja volt Solarworks (for example installation);
• protect its violated or disputed rights (e.g. passing data to a court);
• fulfil its obligations arising from legislation (e.g. passing data to an investigative body).
4. Customer Data
OÜ Amper ja volt Solarworks processes the Customer Data that OÜ Amper ja volt Solarworks has learned about the Customer in the course of the transaction relationship, or by the Customer expressing a wish to enter into one, in accordance with the purposes of Customer Data processing.
OÜ Amper ja volt Solarworks does not sell, rent or otherwise transfer Customer Data to Third Parties or make it available for Third Parties’ use.
5. Storage and processing of Customer Data
OÜ Amper ja volt Solarworks confirms that:
• we protect Customer Data with strict confidentiality and security rules and have taken all necessary measures to protect Customer Data;
• we limit the processing of Customer Data to the minimum needed to fulfil the purposes of Customer Data processing described in section 3;
• we process Customer Data as long as is necessary to fulfil the purposes of Customer Data processing or obligations arising from legislation;
• we allow access to Customer Data only to employees of OÜ Amper ja volt Solarworks who have the right to process Customer Data only to the extent necessary to achieve the purposes of Customer Data processing;
• we require all cooperation partners with whom we cooperate in processing Customer Data (e.g. IT or consulting firms) to comply with the same Customer Data Processing Principles.
6. Processing of Customer Data in direct marketing
If the Customer has given their contact details (e.g. postal address, e-mail address, telephone, etc.) to OÜ Amper ja volt Solarworks, they have thereby consented to receiving information about the products and services of OÜ Amper ja volt Solarworks.
The Customer also has the right at any time to notify OÜ Amper ja volt Solarworks that they no longer wish to receive offers from OÜ Amper ja volt Solarworks. We do not consider messages related to providing, administering or performing a contract for a product or service (e.g. information about the expiry and renewal of a subscription, a reminder to pay an invoice) to be offers from OÜ Amper ja volt Solarworks.
7. The Customer’s rights regarding personal data
- Right of access to personal data – the right to know what data OÜ Amper ja volt Solarworks keeps about the Customer and how it is processed, including the right to know the purpose of processing, the persons to whom personal data is disclosed, information about automated decision-making, and the right to receive copies of one’s personal data.
- Right to rectification of personal data – the right to demand the correction of inadequate, incomplete and incorrect personal data.
- Right to withdraw consent to the processing of personal data – the Customer has the right at any time to withdraw the consent given to OÜ Amper ja volt Solarworks for the processing of personal data for the purposes of consumer games and campaigns. Please note that withdrawing consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.
- Right to erasure of personal data (“right to be forgotten”) – the Customer has the right to demand that OÜ Amper ja volt Solarworks erase the Customer’s personal data. OÜ Amper ja volt Solarworks has the right to refuse to erase personal data if the processing is necessary for OÜ Amper ja volt Solarworks to comply with a legal obligation, to exercise the right of freedom of expression and information, to establish, exercise or defend legal claims, or in the public interest.
- Right to restriction of processing – in certain cases the Customer has the right to prohibit or restrict the processing of their personal data for a certain period.
- Right to object and to complain – the Customer has the right to submit objections or complaints to OÜ Amper ja volt Solarworks about the processing of their personal data if the processing takes place on the basis of the legitimate interest of OÜ Amper ja volt Solarworks, the public interest, for marketing purposes, or if the Customer’s rights have been violated in the processing of Customer Data. OÜ Amper ja volt Solarworks responds immediately to an objection to the processing of personal data for direct marketing purposes.
- Right to data portability – if the processing of the Customer’s personal data is based on the Customer’s consent and the personal data is processed by automated means, the Customer has the right to receive the personal data concerning them that the Customer has provided to OÜ Amper ja volt Solarworks as the controller, in a structured, commonly used and machine-readable format.

8. “Cookies”
OÜ Amper ja volt Solarworks uses “cookies” on its website, which the Customer can accept if they decide to use the website of OÜ Amper ja volt Solarworks. “Cookies” help OÜ Amper ja volt Solarworks improve the services offered to the Customer and make them more convenient for you.
We collect data about how the Customer interacts with the website and/or application of OÜ Amper ja volt Solarworks. In addition, we collect information from the Customer’s computer or device, such as the IP address, the web browser the Customer uses and language settings. We use this data for statistical purposes to improve the websites and applications of OÜ Amper ja volt Solarworks and to display content tailored to the Customer.

9. Retention of Customer Data
OÜ Amper ja volt Solarworks has the right to record all Customer notices and instructions given by means of communication (e-mail, telephone, etc.), as well as other actions taken by the Customer, and where necessary to use these recordings to prove instructions or other actions.
OÜ Amper ja volt Solarworks retains data related to a customer contract for the duration of the customer contract and for 8 years after it, and data needed to fulfil obligations arising from law (for example 7 years for accounting).
10. Changes to the Customer Data processing principles
OÜ Amper ja volt Solarworks has the right to change the Customer Data processing principles unilaterally.
OÜ Amper ja volt Solarworks will notify the Customer of changes to the Customer Data processing principles within a reasonable time on the website of OÜ Amper ja volt Solarworks, by e-mail or in another way.
